Clare Thompson, Partner and Head of our Clinical Negligence Team at Hay & Kilner, acted on behalf of a client who was awarded damages in the sum of £300,000 in March 2022.
The clinical negligence claim arose out of alleged negligence by the client’s GP, who erroneously marked the Claimant’s abnormal blood test results as normal on the basis of which no further action was taken. It is alleged that had further investigations been performed, as indicated, this would have led to an earlier diagnosis and subsequent treatment of the Claimant’s renal impairment before significant and irreparable damage was sustained. It was alleged that the Claimant’s opportunity to conceive and likelihood of a successful pregnancy and birth was compromised as a result. Expert evidence was obtained from an independent General Practitioner, a Consultant Nephrologist, and a Consultant Obstetric Physician, all of whom were supportive of the claim.
Although early admissions were made in respect of breach of duty, the Defendants did not admit causation, and the Claimant issued legal proceedings in August 2021.
Negotiations took place, and, during a mediation which took place in March 2022, a final offer in the sum of £300,000 was made by the Defendant and accepted by the Claimant. The Claimant was extremely pleased with this result.
